The petitioner seeks regular bail in connection with POCSO Case No. 81 of 2019 arising out of Sasaram Town P.S. Case No. 767 of 2019 for the offence punishable under Sections 341, 323, 354(B), 302, 506, 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 8 of POCSO Act. The allegation is regarding the son of the petitioner having fired gun shots in the abdomen of the daughter of the informant, while she was returning from the temple, resulting in her death.

The learned counsel for the petitioner has submitted that the petitioner is innocent and she has been falsely implicated in the present case on account of misdeeds of her

Patna High Court CR. MISC. No.72639 of 2019(2) dt.13-01-2020 2/2 son. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.08.2019. Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that there is no allegation against the petitioner of having assaulted the deceased victim lady, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Sasaram, Rohtas in connection with Sasaram Town P.S. Case No. 767 of 2019.
