13-02-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Rajoun P.S. Case No. 334 of 2019 registered for the offence under Sections 379, 411 of the Indian Penal Code, Section 40 of BMMC Rules 1972, Section 8 of BPIN Rules 2003, Section 21 of MMRD 1977 and Section 15 of Forest & Environment Protection Act, 1986.

The allegation against the petitioner is that his vehicle was regularly being used for carrying the sand of the river Chandan without valid challan and thus, causing huge loss to Mining department.

In view of specific allegation against the petitioner that being owner, he was using his vehicle for carrying sand without valid challan, I am not inclined to extend the privilege of bail to him.
