Petitioner prays for bail in connection with Korha P.S.Case No. 125 of 2017 registered for the offences punishable under Sections 20, 22 of N.D.P.S. Act and Sections 25(1-B)(a) and 26 of the Arms Act.
Allegation is of recovery of 4.6 kg. of ganja from the petitioner and altogether there is recovery of more than 8 kg. of ganja.
It appears that petitioner earlier moved this Court for bail in Cr.Misc.No. 14624 of 2018, which was rejected vide order dated 3.5.2018.
Submission of learned counsel for the petitioner is that petitioner is in custody since 4.5.2017 and though he is accused in
Patna High Court Cr.Misc. No.52358 of 2018 (2) dt.05-10-2018 2/2 five other cases but in most of the cases he is on bail. Heard learned APP also.
Having heard both sides and in the facts and circumstances and also considering the fact that recovered ganja is less than the commercial quantity, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Katihar, in connection with Korha P.S.Case No. 125 of 2017, corresponding to G.R.No. 1708 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
