JUSTICE SANJAY PRIYA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and State. This application has been filed for modification of the order dated 21.06.2018 passed by this Court in Cr. Misc. 25951 of 2018.

It has been submitted that petitioner was granted provisional anticipatory bail for a period of twelve months by the aforesaid order but he could not surrender in the court below within stipulated time as he could not arrange amount of 1st installment of Rs.3,00,000/-. Therefore, he seeks further one month time to make arrangement of money and surrender before the court below.

In such circumstances, this modification application is allowed to the extent that time for surrender of the petitioner in

Patna High Court Cr.Misc. No.49079 of 2018 (2) dt.29-08-2018 2/2 the court below is extended for further four weeks from the date of receipt/production of a copy of this order. If the petitioner surrenders in the court below, he will be released on same terms and conditions as mentioned in the order dated 21.06.2018 passed in Cr. Misc. 25951 of 2018.

Let this order be communicated to the Court of Additional Chief Judicial Magistrate-1st, Bhagalpur, in connection with Nath Nagar P.S. Case No. 629 of 2017.
