The petitioner seeks bail in connection with K. Hat (Sahayak) P.S. Case No.1023 of 2023 registered for the offence under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is to have committed murder of son of the informant along with other coaccused persons. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case on the basis of suspicion. It is submitted that there is no eye-witness to the occurrence. It is

No.4542 of 2024(3) dt.06-03-2024 2/2 further submitted that the specific allegation as regard to commit murder is not against this petitioner rather specific allegation is against other co-accused, namely, Shanker Yadav. It is also submitted that similarly situated co-accused person has already been granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 10945 of 2024 on 22.02.2024. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 04.09.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with K. Hat (Sahayak) P.S. Case No.1023 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea.
