The Petitioner seeks regular bail in connection with Sessions Trial No. 407 of 2018 arising out of Matihani P.S.Case No. 574 of 2017, registered for offences punishable under Sections 364, 302, 120 B/34 of the Indian Penal Code. Allegation as per F.I.R. is that the petitioner along with other is of kidnapping the son of the informant and committing murder.

Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and he has been made accused on the confessional statement of other co-accused and the other co-accused persons have been granted by Coordinate Benches of this Court vide order 27.06.2018, passed in Cr. Misc. No. 35515 of 2018 and vide order dated 20.09.2018

Patna High Court Cr.Misc. No.52210 of 2018 (3) dt.04-10-2018 2/2 passed in Cr. Misc. No. 49702 of 2018 and the petitioners is in custody since 21.03.2018 and charge sheet has also been submitted against the petitioner.

Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II, Begusarai in connection with Sessions Trial No. 407 of 2018 arising out of Matihani P.S.Case No. 574 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
