The petitioner seeks bail in connection with POCSO Case No. 47 of 2019, arising out of Ara Town P. S. Case No. 340 of 2019 dated 19.07.2019 instituted for the offence under Sections 376/376(F), 370/370(A), 370(AB) and 376 (DB) of the Indian Penal Code, Sections 4, 6 and 8 of the POCSO Act, 2012, Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 and Section 5 (c) of the Immoral Traffic (Prevention Act, 1956.

Patna High Court CR. MISC. No.78430 of 2019(4) dt.16-03-2020 2/2 Mr. Vikram Deo Singh, learned Advocate for the petitioner has submitted that the petitioner is not named in the F.I.R. nor the victim girl has named him in her statement under Section 164 Cr.P.C.

However, considering the entire set of facts collected during the course of investigation, I am not inclined to grant bail to the petitioner notwithstanding the fact that he is in custody since 31.07.2019. Accordingly, prayer for bail is rejected.

That charge-sheet in this case having been submitted long time back, this Court directs that the trial of the accused persons should commence without any delay and be concluded also expeditiously.
