2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.

3. As per prosecution case, informant alleges that on 15.05.2024 at around 10:30 PM while he was returning home in the meanwhile, this petitioner, in an inebriated state, started abusing him and attacked informant with a fighter causing serious eye injury. It is further alleged that upon intervention, father of informant was also assaulted with rod and informant's elder brother was assaulted by a sharp weapon resulting in

Patna High Court CR. MISC. No.86798 of 2024(2) dt.21-02-2025 2/3 severe head injury. Later, this petitioner and co-accused Gabbar Singh came to informant's house, abused the female members of the family and also issued death threats.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case. As a matter of fact, on the alleged date and time of occurrence, a free fight took place between the parties over a petty dispute in which both sides sustained injuries. There is case and counter-case between the parties. Petitioner is in custody since 31.07.2024. Moreover, charge-sheet has already been submitted. Petitioner has got no criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances, case and counter-case between the parties, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I,
