2. The petitioner is apprehending arrest in connection with Barauli P.S. Case No. 121 of 2024 lodged on 08.04.2024, for the offence punishable under Sections 419, 420, 467 & 468 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against the sole petitioner. It has been alleged in the FIR that petitioner had downloaded the electricity bill of the informant from the NBPDCL website and made a rent agreement by using the forged signature of the informant. Furthermore, the petitioner has allegedly used this document to create a GST certificate and
Patna High Court CR. MISC. No.84457 of 2024(3) dt.12-05-2025 2/3 registered a business named SHIVA AGROVET, which she was running illegally. The informant further alleges that this incident has tarnished his reputation.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is a silent member of the business and whatever has been done, it has been done only by her husband. But, as soon as petitioner received information of the alleged incident, she immediately closed the bank account as well as initiated the process for cancellation of the GST certificate. Counsel submits that such mistake shall not take place in future. Counsel submits that a photocopy of cancellation of GST registration is annexed as Annexure-P/2 and a photocopy of closure of bank account is annexed as Annexure-P/3. Counsel submits that the actual event is otherwise. He submits that when the informant got to know that the business of petitioner is growing day by day, then with ill intention, he demanded share from the petitioner and when petitioner's husband denied for the same, the present case has been lodged. Counsel further submits that petitioner has no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that petitioner is the proprietor

6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 121 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
