The petitioner is languishing in custody for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 20/22/29 of the N.D.P.S. Act. 15 grams of Ganja was recovered from the possession of the petitioner and thereafter on disclosure of the petitioner from his house 500 grams of Ganja and five bottles of foreign liquor was recovered.

Submission is that the petitioner is a drug addict and the recovered quantity was not a commercial quantity. The petitioner is in custody since 26.08.2019. The petitioner has stated on oath that he has got no criminal antecedent.

Patna High Court CR. MISC. No.77509 of 2019(2) dt.28-11-2019 2/2 Investigation of the case is already complete. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.7658 of 2019, arising out of Parsa Bazar P.S. Case No.287 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
