The petitioner, in the present case, is seeking regular bail in connection with Excise Case No. 110 of 2018, registered for offences alleged under Section 30(d) of the Bihar Prohibition and Excise Act, 2016 and Sections 2(C), 3, 5 and 13 of Mahua Flowers Rule 2006.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.07.2018 in connection with the present case, he has no criminal antecedent and the allegation is that the vehicle which he was driving was carrying 1920 kg of Mahua Flower.

Patna High Court Cr.Misc. No.52485 of 2018 (4) dt.28-09-2018 2/2 No one appears for the State to oppose this application.

Considering the facts and circumstances of the case whereunder the petitioner is said to be the driver of the vehicle and the seizure is of Mahua Flower and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Gaya in connection with Excise Case No.110 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
