The petitioner seeks regular bail in connection with Kotwali Barai P.S.case No.444 of 2019 dated 25.5.2019 registered for offences punishable under Sections 366(A), 341 and 323/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that as a matter of fact there is love affair between them and she has gone on her own sweet will and the medical report also discloses that she is 18 years of age.

Heard learned A.P.P. who has opposed the prayer for bail, however he has conceded that some independent witnesses

Patna High Court CR. MISC. No.74127 of 2019(3) dt.25-02-2020 2/2 have also not supported the case and moreover the girl was aged about more than 18 years as per the medical report. Petitioner is in custody since 13.6.2019..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Addl. District and Sessions Judge cum Special Judge POCSO, Bhagalpur in connection with Kotwali Barari P.S.case No.444 of 2019 with condition to co-operate in the disposal of the trial. With the above direction, this application is allowed.
