The petitioner seeks regular bail in Town (Mahila) P.S. Case No. 33/2017, instituted for the offences punishable under Section 376D of the Indian Penal Code and section 4 of the P.O.C.S.O. Act Learned counsel for the petitioner has submitted that victim girl in her statement recorded under Section 164 Cr.P.C has stated that she was taken at different places by the accused persons and they committed rape upon her. From her statement, it appears that nothing was done forcibly by the accused persons. It is further submitted that Guddu Kumar, Manish Kumar and other person have already been granted bail by different benches of this court vide order dated 07.03.2018
Patna High Court Cr.Misc. No.54026 of 2018(6) dt.27-11-2018 2/2 passed in Cr. Misc. No. 7150/2018, dated 12.07.2018 passed in Cr. Misc. No. 40267/2018 and dated 21.03.2018 passed in Cr. Misc. No. 7607/2018. Petitioner is in custody since 30.07.2018. Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Ist Judge-cum-Special Judge, P.O.C.S.O. Act, Aurangabad in connection with Town (Mahila) P.S. Case No. 33/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
