The petitioner, who is in custody since 29.08.2019 and is a person of clean antecedent, seeks bail in connection with Srinagar Pujahan P. S. Case No. 58 of 2019 dated 28.08.2019, instituted for the offences under Sections 413 and 414 of the Indian Penal Code.

The petitioner along with another is said to have been arrested with stolen motor-cycle.

The learned counsel for the petitioner submits that there is no report about the theft of such motor-

Patna High Court CR. MISC. No.74226 of 2019(2) dt.11-12-2019 2/2 cycle and his implication in this case is on the basis of mistaken identity. He has got absolutely no concern with the motor-cycle in question which stated to be stolen property.

Regard being had to the nature of accusation, the period of custody of the petitioner and his being a person of clean antecedents, this petition is allowed. The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bettiah, District - West Champaran in connection with Srinagar Pujahan P. S. Case No. 58 of 2019.
