JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Neither petitioner was caught on the spot nor anything was recovered from his conscious possession.

Although, petitioner does have criminal antecedent but para 3 of the petition goes to show that petitioner was never made accused under the provision of Excise Act. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court CR. MISC. No.74664 of 2019(2) dt.04-12-2019 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Srinagar Pujaha P.S. Case No. 112 of 2018.
