2. Heard learned counsel for the Petitioners and learned APPs for the State.

3. The petitioners apprehend their arrest in connection with Amarpur P.S. Case No. 515 of 2024 dated 31.07.2024 registered for the offences punishable under Sections 126(2), 115(2), 74, 109(1), 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS').

4. Mr. Md. Najmul Hodda, learned counsel appearing for the petitioner submits that all the petitioners have fair and clean antecedent, both the parties are co-villagers and close relatives, in fact, on the alleged day and time of occurrence, a dispute arose in between them for fetching water from a hand pump installed under Nal Jal Yojana scheme which resulted in free fight in between both the parties and consequently, both the sides lodged the cases against each other. It is further submitted that in the present matter, two persons are said to have sustained injuries whose injury reports have been filed as Annexure-2 which shows that they have sustained simple injuries.

5. Learned APPs for the State have opposed the prayer for bail of the petitioners.

6. Considering the submissions made by petitioners' counsel and also taking into account the fair and clean antecedent of the petitioners, this Court is inclined to accept the prayer for bail of the petitioners. Accordingly, let the petitioners

No.83626 of 2024(2) dt.11-12-2024 3/3 named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Amarpur P.S. Case No. 515 of 2024, subject to the conditions as laid down under Section 484(2) of the B.N.S.S.
