JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mufassil P.S. Case No. 225 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
As per FIR on information of manufacturing liquor police raided the place and recovered articles for manufacturing liquor and 10 litres of Mahua liquor from there and accused persons, including the petitioner succeeded in fleeing away. Submission of learned counsel for the petitioner is that there is no source of identification of the petitioner at that time of occurrence mentioned in the FIR, petitioner has no criminal antecedent and on the basis of suspicion he has been made accused in this case.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IIcum-Special Judge, Nawada, in connection with Mufassil P.S. Case No. 225 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
