JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Special Case No. 8696 of 2019, arising out of Barh P. S. Case No. 447 of 2019, disclosing offences under Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. Police got an information that the petitioner and other accused persons are manufacturing the Mahua Liquor and on that information, police raided near the house of the Bhagirath Yadav, where several other articles were also recovered. Apart from that some liquors were also recovered. The villagers have disclosed that petitioner, who is the person who has succeeded in fleeing away. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge Excise, Patna, in connection with Special Case No. 8696 of 2019, arising out of Barh P. S. Case No. 447 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
