2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Buniyadganj P.S. Case No. 186 of 2024 instituted for the offence under Sections 191(2), 190, 126, 115(2), 109, 121(1), 121(2), 125(a), 125(b) and 132 of B.N.S.
3. The case of the prosecution is that the informant was directed to talk on a mobile number and to act accordingly. After having talks, the informant went to the house of Shanti Devi where he found that twenty five to thirty persons have surrounded the house of Shanti Devi, assaulting and causing mischief. As the police reached there, the petitioner and others got furious and
Patna High Court CR. MISC. No.85556 of 2024(2) dt.13-12-2024 2/3 started assaulting and pelting stones upon police. It is also alleged that in this assault, the informant has received injuries. Altogether eleven persons were identified and these petitioners were amongst them.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. Learned counsel for the petitioners submitted that son of Shanti Devi has kidnapped the son of the Munni Devi which is apparent from annexure-P/2 and for that, this case has been filed and this case is only a retaliatory act at the instance of Shanti Devi. From perusal of the FIR, it is clear that there is no specific allegation against the petitioners and the nature of allegation is general and omnibus.
5. Learned APP for the State has opposed the prayer of bail of the petitioners and submitted that petitioners have criminal antecedents.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Buniyadganj P.S. Case No. 186 of 2024, they

No.85556 of 2024(2) dt.13-12-2024 3/3 will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned Court of JMFC, Gaya subject to the conditions as laid down under section 438(2) of the Cr.P.C.
