The petitioners seek pre-arrest bail in connection with Kishanpur P. S. Case No.358 of 2017 registered under Sections 341, 323, 447, 385, 379, 504 and 506 of the Indian Penal Code. At the outset, Mr. Pramod Mishra, learned counsel for the petitioners contended that since the petitioners were granted pre-arrest bail prior to competition of investigation, the instant application for grant of pre-arrest bail after submission of the charge-sheet and taking cognizance of the offence would not be maintainable.
