Petitioner seeks regular bail in connection with Special Excise Case No.7458 of 2019 arising out of Jakkanpur P.S. Case No.543 of 2019, for the offence punishable under Sections 365, 363/34 of the Indian Penal Code. The allegation against the petitioner in the First Information Report is that the police recovered a total quantity of 33.600 litres of illicit liquor from the owner of Ravi Enterprises. It has further been been alleged that the petitioner along with other accused persons were standing near the Ravi Enterprises where the illicit liquor was kept. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case merely on the

No.75745 of 2019(2) dt.27-11-2019 2/2 basis of the fact that he was standing near Ravi Enterprises and illicit liquor has been recovered from the back side near Ravi Enterprises. Learned counsel further submits that no illicit liquor has been recovered from the conscious possession or the premises belonging to the petitioner and the petitioner is in custody since 20.08.2019.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 20.08.2019 and he was found standing near the Ravi Enterprises, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Excise Case No.7458 of 2019 arising out of Jakkanpur P.S. Case No.543 of 2019.
