JUSTICE RAKESH KUMAR ORAL ORDER 11-09-2018 At the very outset, Sri Pramod Kumar Verma, learned counsel for the petitioners in presence of learned Additional Public Prosecutor submits that during pendency of this anticipatory bail petition, petitioner no. 3 /Suresh Yadav and petitioner no. 6 / Ram Chandra Yadav have already been arrested , and as such , their petition has become infructuous. Accordingly, the present anticipatory bail petition so far petitioner nos. 3 and 6 is concerned stands dismissed as same has become infructuous.
After some argument, Sri Pramod Kumar Verma ,
Patna High Court Cr.Misc. No.54040 of 2018(2) dt.11-09-2018 2/2 learned counsel for the petitioners in presence of learned Additional Public Prosecutor requests for disposal of the present petition, so that, petitioners may appear before the court below and pray for regular bail.
The prayer is allowed.
The anticipatory bail petition stands disposed of with observation that if within a period of six weeks from today petitioners appear before the court below and pray for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
