====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Dehri Nagar P.S. Case No. 500 of 2018 registered for the offences punishable under Sections 147, 332, 333, 353, 308 and 427 of the Indian Penal Code. The allegation is regarding an accident having taken place resulting in death of a person whereupon the villagers are said to have assembled at the place of incident, resulting in the police force arriving there. However, the accused persons named in the F.I.R. alongwith 50-60 unknown accused persons had tried to obstruct the police in discharging their official duties as well as had engaged in altercation with the police force.

No.72850 of 2019(2) dt.20-11-2019 2/2 Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case inasmuch as the present incident has arisen out of a mob fury on account of death of one of the co-villagers in an accident. It is further submitted that the petitioners are having clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas, Bihar in connection with Dehri Nagar P.S. Case No. 500 of 2018 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
