2.The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with Chand P.S. Case No. 216 of 2025 registered for the offences punishable under Sections 96, 64 and 3(5) of the BNS and Section 6 of the POCSO Act.

3. As per FIR, petitioner helped main co-accused namely Ajit Maurya, who is none but elder brother of petitioner to commit penetrative sexual assault/rape along with one unknown co-accused person.

4. It is submitted by learned counsel appearing on behalf of the petitioner that due to land dispute as informant is the next door neighbor of the petitioner, present false case was lodged. It is submitted that main co-accused Ajit Maurya against whom allegation of rape/penetrative sexual assault appears available is the own elder brother of this petitioner and this is also

Patna High Court CR. MISC. No.79218 of 2025(2) dt.19-11-2025 2/2 one of the reason for false implication of this petitioner. While concluding arguments, it is submitted that above named petitioner is a man of clean antecedent.

5 Learned APP while opposing the prayer of bail could not disputed aforesaid factual submission.

In view of aforesaid factual and legal submission and by taking note of fact as main thrust of allegation qua committing rape is available against co-accused Ajit Maurya, who is in judicial custody, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge VIth cum Special Judge POCSO Act, Kaimur at Bhabua/concerned Court, where the case is pending in connection with Chand P.S. Case No. 216 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
