Earlier, the bail application of the petitioner was rejected vide order dated 21.06.2023 passed in Cr. Misc. No. 14465 of 2023.

The petitioner has prayed for regular bail in this case registered for the offence punishable under sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act. In pursuance to the direction of this Court, a fresh report with regard to the present stage of trial was received on 16.01.2024, which has been kept at Flag 'R', from which it appears that this case has been committed on 09.01.2024 in the learned Court of Sessions and next date of this case was fixed for 24.01.2024.

Learned counsel for the petitioner submitted that the

Patna High Court CR. MISC. No.83310 of 2023(4) dt.20-03-2024 2/2 trial has not been concluded as yet and there is no hope to conclude the same in the near future because charges have not been framed up till now, however, the petitioner is languishing in judicial custody since 24.11.2022. Learned counsel for the petitioner further submitted that general and omnibus allegation is levelled against the petitioner and similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 21.06.2023 passed in Cr. Misc. No. 31366 of 2023.

Having heard learned counsel for the parties and considering the gravity of this case as well as judicial custody, this court is inclined to enlarge the petitioner on bail after framing of charge, if not framed. The above named petitioner is directed to be released on bail in connection with Mansoorchak P.S. Case No. 92 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial MagistrateIst Class, Begusarai.
