2. The petitioner is in custody since 14.08.2023 in connection with Nawkothi P.S. Case No. 102/2023 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have assaulted the deceased and his family members. Co-accused Ankaj Singh fired which hit Tripurari Singh who succumbed to his injuries.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel further submits that the specific allegation of firing is

Patna High Court CR. MISC. No.83795 of 2023(2) dt.10-01-2024 2/2 against Ankaj Singh not this petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the fact that the petitioner is not the person who had fired upon the the deceased and also the fact that the deceased has been killed in a free fight, let the petitioner above named be released on bail after framing of charge, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Nawkothi P.S. Case No. 102/2023.
