The petitioner seeks for bail in connection with Goreyakothi P.S. Case No.185 of 2020, registered for the offence punishable under Sections 413, 414, 34 of the Indian Penal Code.

A stolen motorcycle was allegedly recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 29.06.2021 passed in Cr. Misc. No. 10248 of 2021. He submits that the petitioner has got no any concern or connection either with co-accused Santu Kumar or motorcycle in question. He further submits that petitioner has one criminal antecedent as

Patna High Court CR. MISC. No.84933 of 2024(2) dt.05-02-2025 2/2 stated in para-3 of the bail application and he is languishing in judicial custody since 20.09.2024.

5. Learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail after framing of charge on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Goreyakothi P.S. Case No. 185 of 2020, subject to the condition:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below. (b) The petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the county without permission of the trial court.
