On getting confidential information, regarding assemblage of anti-social elements for the purpose of commission of offence, raid was conducted and during course thereof, four persons were apprehended including the petitioner while few persons managed to escape. On search, from possession of Mayank Kumar, two country made loaded pistol along with cartridge, PAN Card, Mobile, SIM etc. were seized. While from possession of the petitioner, two Samsung Mobile Set and two live cartridges were recovered. From possession of Brajesh Pandey, one Samusng Mobile Set, PAN Card and one Knife were

Patna High Court Cr.Misc. No.53252 of 2018 (2) dt.10-09-2018 recovered and from possession of Chandan Kumar two live cartridges have been seized. Apart from this, other items including cash, motorcycles ets. were also seized.

Considering the manner of recovery, which have been shown from possession of the petitioner casting doubt along with absence of criminal antecedent as well as being in custody since 17.06.2018, petitioner Kanhai Thakur @ Kanhai Kumar Thakur is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S.
