JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-12-2024 The present writ petition has been filed seeking the following reliefs:- "1. (i) To restrain the respondents from constructing Panchayat Sarkar Bhawan and digging the foundation thereof at Datmi village, falling within Nataul Gram Panchayat of Dhanarua Block, District-Patna.

(ii) To construct Panchayat Sarkar Bhawan at the main central location

Patna High Court CWJC No.18147 of 2024(2) dt.09-12-2024 2/3 of the Nataul Gram Panchayat on the land appertaining to Mauza Nataul, Thana No. 267, Khata No. 45, Khesra No. 562, having an area of 1.23 acres.

(iii) To hold that the present location of the proposed Panchayat Sarkar Bhawan has been decided without adhering to the various directions and guidelines issued by the State Government and other authorities, including absence of any resolution from the Gram Panchayat, which depicts arbitrary and whimsical action by the Mukhiya, i.e. the Respondent No. 9.

(iv) To hold that the present location of the Panchayat Sarkar Bhawan is in violation of the guidelines contained in letter dated 26.11.2019, issued by the Panchayati Raj Department."

At the outset, the learned senior counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Patna, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the

Patna High Court CWJC No.18147 of 2024(2) dt.09-12-2024 3/3 petitioner approaches the District Magistrate, Patna, by filing appropriate representation, within a period of one week from today, the same shall be considered and disposed off by a reasoned and a speaking order, in accordance with law, within a period of four weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
