2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Patory P.S. Case No. 57 of 2024 instituted for the offence under Sections 341, 323, 325, 379, 354, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that all petitioners arrived at the house of the informant and started abusing on this, the husband of the informant came out of the house and Ranjan

Patna High Court CR. MISC. No.85567 of 2024(2) dt.13-12-2024 2/3 Rai (petitioner no.1) told the husband of the informant to sell the land adjacent to the land of the petitioners. After this, petitioner Ranjan Rai orderded to kill. Many rounds of fire were made. Satya Narayan Rai received fire arm injuries on his eyebrow. It is further alleged that all the accused persons assaulted the husband and brother-in-law of the informant.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. Learned counsel for the petitioners during argument, submitted that there is also a counter version of this case. It has also been argued that due to intervention of well-wishers, good sense has been prevailed between the parties and both parties are ready to compromise and for that compromise petition has been filed in the trial Court which is annexed with this petitioner as Annexure-P/2. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent.

5. Learned APP for the State has opposed the prayer of bail of the petitioners.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four

Case No. 57 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Samastipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
