2. The petitioners apprehend their arrest in connection with Patauna P.S. Case No. 53 of 2025 registered for the offence under Sections 126(2), 115(2), 118(1), 117(2), 109, 74, 352, 351(2), 3(5) of the B.N.S.

3. As per the prosecution case, petitioner is accused of assaulting the informant with iron rod on his head.

4. It has been submitted by the learned counsel for the petitioners that the petitioners are innocent and they have falsely been implicated in this case. It is next submitted that both the informant and petitioners are brothers because of

Patna High Court CR. MISC. No.81814 of 2025(4) dt.25-02-2026 2/2 dispute over land they have fought with each other because of which injury has been sustained by both the petitioner and the informant. Petitioners have clean antecedent.

5. The Doctor who has given the injury report has appeared and has submitted his explanation.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioners, above named, in the event of their arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., Benipatti/ concerned Court below in connection with Patauna P.S. Case No. 53 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
