JUSTICE SOURENDRA PANDEY ORAL ORDER 06-05-2025 Heard the learned counsel for the petitioner Mr. Bijay Prakash Singh appearing on behalf of the petitioner and Mrs. Meena Singh, the learned Additional Public Prosecutor for the State.

2. The petitioner seeks regular bail in connection with Sessions Trial No. 658 of 2023 arising out of Bhagwanpur Hat P.S. Case No. 127 of 2023, registered for the offences punishable under Sections 341, 323, 324, 302 and 34 of the Indian Penal Code.

3. The allegation against the petitioner is that she along with other co-accused persons, namely, Sabnam Khatoon and Golu Sheikh, in furtherance of common intention, had assaulted on the head of Husna Khatoon by means of Dab and

Patna High Court CR. MISC. No.82819 of 2024(5) dt.06-05-2025 2/3 Tangi causing her death, who happens to be the mother of informant and had even tried to conceal the dead body in the room and locked the room from outside.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated by the informant. Learned counsel further submits that there is no eyewitness to the said occurrence and only because of suspicion her name has transpired in the present case. Learned counsel for the petitioner has drawn the attention of this Court towards the supplementary affidavit which was filed bringing on record, the deposition of five prosecution witnesses who have been examined on behalf of the prosecution in the trial before the court below and from perusal of the same, it is clear that neither the other prosecution witnesses nor the informant has herself supported prosecution case. Lastly, he submits that petitioner is in custody since 14.04.2023 and she is having clean antecedent.

5. Learned Additional Public Prosecutor for the State has opposed the prayer for bail.

6. Considering the aforesaid submissions made by the respective parties and taking into account the contradictory statement of the informant as also from perusal of the case diary it appears that none of the witnesses are eye witness and the

Patna High Court CR. MISC. No.82819 of 2024(5) dt.06-05-2025 3/3 fact that petitioner having clean antecedent is in custody since 14.04.2023, I am inclined to grant the petitioner privilege of regular bail.

7. Accordingly, the prayer for bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned District and Additional Sessions Judge-II, Siwan, in connection with Sessions Trial No. 658 of 2023 arising out of Bhagwanpur Hat P.S. Case No. 127 of 2023.
