2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
3. As per FIR, two accused persons forcefully abducted the informant and took him to Prash Pokhar where they tied his limbs and mouth. Accused persons ran away from there and they also robbed his mobile and Rs. 5000/- from his purse.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that during course of investigation, it has come that the stolen mobile is being used with SIM No. 9572587752 issued in the name of the petitioner on 6th July, 2018 and only on
Patna High Court CR. MISC. No.84503 of 2023(2) dt.12-01-2024 2/2 that basis, he has been made accused in this case. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Manjhi P.S. Case No. 269 of 2021.
