This application has been filed on behalf of the petitioner Manoj Gupta @ Munna Gupta @ Manoj Kumar Gupta for modification in the order dated 04.11.2015 passed in Criminal Misc. No. 46060 of 2015, whereunder the petitioner was granted privilege of pre-arrest bail with direction that if the petitioner surrender before the court below within a period of four weeks, he shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas in connection with Chenari P.S. Case No. 121 of 2015 imposing five conditions, as detailed in

Patna High Court CR. MISC. No.79417 of 2019(2) dt.08-01-2020 2/2 the order, while prayer for bail of other co-accused was refused.

Learned counsel for the petitioner submits that after passing of the order on 04.11.2015 in Criminal Miscellaneous No. 46060 of 2015, the petitioner Manoj Gupta @ Munna Gupta @ Manoj Kumar Gupta became mentally disorder and he was under treatment in the locality and due to that reason, he could not surrender before the court below within the stipulated period.

In such view of the matter, the time to surrender of petitioner, as per order dated 04.11.2015 passed in Criminal Miscellaneous No. 46060 of 2015, is further extended by four weeks from today in connection with aforesaid case. Accordingly, the modification application is allowed and the order dated 04.11.2015 passed in Criminal Miscellaneous No. 46060 of 2015 is modified to the above extent.
