====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Manjhi P.S. Case No.145 of 2023, registered for the offences punishable under Sections 413, 414 of the Indian Penal Code and under Sections 25(1-b)a/26/35 of the Arms Act.

3. As per the prosecution case, the petitioner alongwith co-accused Vishal Singh @ Babuajee were arrested by the Police and from the possession of co-accused Vishal Singh @ Babuajee countrymade pistol and from the possession of petitioner a Mobile was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner was talking with the co-

No.82709 of 2023(2) dt.15-01-2024 2/2 accused when the Police arrested him and the recovered Mobile belongs to the petitioner and only on the basis of suspicion the petitioner was arrested who is in custody since 12.05.2023. He also submits that the recovered motorcycle also does not belong to the petitioner and he has one criminal antecedent.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with Manjhi P.S. Case No.145 of 2023.
