Petitioners apprehend their arrest in a case registered for the offence under sections 307, 504, 506 and other allied sections of the Indian Penal Code read with section 27 of the Arms Act.

Petitioner no.1 is said to have given Chura blow on the nephew of the informant, which is supported by the injury report. So far as petitioner no.2 is concerned, there is allegation that he caused firearms injury on the neck of the victim but no such firearms injury has been found in the injury report. There is a case and counter case in which both sides sustained injuries.

In view of the facts and circumstances of the case, prayer for bail of the petitioner no.1 is rejected with direction to surrender and seek regular bail within a period of six weeks which would be disposed of own its own merit without prejudice.

Prayer for bail of petitioner no. 2 is allowed. In the event of arrest/surrender within six weeks, let him as mentioned

Patna High Court CR. MISC. No.75704 of 2019(2) dt.27-11-2019 2/2 above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Saran at Chapra in Isuapur Police Station Case No. 22 of 2019, on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
