The petitioners are apprehending their arrest in a case registered under Sections 376, 506,120B of the Indian Penal Code. The allegation against the petitioner is that he along with coaccused Rakesh Kumar tried to drag the informant from her house and on protest, they threatened her of dyre consequences. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused in this case due to mistake of fact. The main allegation is against co-accused namely Rakesh Kumar. General and omnibus allegation has been made
Patna High Court Cr.Misc. No.52384 of 2018 (2) dt.10-09-2018 against the petitioner No. 1. So far as petitioner No. 2 is concerned; she is a lady.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 40 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V./- U T
