The petitioner, in the present case, is seeking regular bail in connection with G.R.P./Kiul P.S. Case No. 225 of 2017, registered for offences alleged under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that it is a case of false implication. The petitioner has been made accused at the instance of the person from whom possession the mobile was recovered. It is submitted that in similar fashion the petitioner is made accused in the other cases also, however, he is on bail in all those cases as stated in paragraph 3 of the application.

Patna High Court Cr.Misc. No.52467 of 2018 (2) dt.28-09-2018 2/2 No one appears on behalf of the State to oppose the application.

Considering the facts and circumstances of the present case where no recovery has been made from the possession of the petitioner, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Kiul, Lakhisarai in connection with G.R.P./Kiul P.S. Case No. 225 of 2017, subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that one of the bailors of the petitioner shall be his family member having no criminal antecedent.
