Petitioner, who is in custody, seeks bail in connection with Simari P.S. Case No. 53 of 2018 registered for the offences punishable under Sections 392, 394, 411, 414 and 34 of the Indian Penal Code.

Informant who is the driver of the Bolero vehicle has alleged that when he was returning home he stopped his vehicle to attend call of nature, in the meantime three miscreants boarding on motorcycle came there and snatched key of his vehicle, mobile phone and cash of Rs. 6,000/- and thereafter assaulted him and threw him in a ditch.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.53229 of 2018(4) dt.26-11-2018 2/2 that he is innocent. He has been falsely implicated in this case only on suspicion Nothing has been recovered from the possession of the petitioner. He is in custody since 02.05.2018. It has been further submitted that similarly placed co-accused Kailash Kumar has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 42856 of 2018 vide order dated 19.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with G.R. No. 1196 of 2018 arising out of Simari P.S. Case No. 53 of 2018.
