JUSTICE MADHURESH PRASAD ORAL ORDER 26-11-2018 Heard learned Counsel for the petitioners, learned Counsel for the State as also the learned Counsel appearing on behalf of respondent Nos. 4 & 5.

The short submission by the writ petitioners is that their appeal dated 16.3.2018 before the Regional Deputy Director of Education, Saran Division, Chapra is kept pending. Learned Counsel for the petitioners submits that in the meantime the petitioners have been visited with the order dated 2.8.2018, issued by the Regional Deputy Director of Education, whereby respondent No. 4 Manoj Kumar Prasad has been

Patna High Court CWJC No.16417 of 2018(3) dt.26-11-2018 2/2 allowed to work as Principal of Madhya Vidyalaya, Kritpur, Anchal Baikunthpur, District Gopalganj and respondent No. 5 Uma Shankar Rai has been allowed to work as Principal of Madhya Visyalaya, Sadauba, Barauli, Gopalganj. From the order dated 2.8.2018 it appears that the issue has been entrusted to a three men committee to examine the validity of promotion granted to Manoj Kumar Prasad and Uma Shankar Rai (respondents 4 & 5 respectively). Since the issue is still being enquired by the authorities no order need be passed in the instant writ petition.

This Court would only observe that the Regional Deputy Director of Education, Saran Division, Chapra should take final decision in the matter expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order, after hearing all concerned.

The writ application stands disposed of.
