JUSTICE SANJAY PRIYA ORAL ORDER 29-08-2018 Heard learned counsel for the Petitioner and the State. The instant application has been filed for modification of the order dated 01.08.2018 passed by this Court in Cr. Misc. 43635 of 2018.

The Petitioner was allowed anticipatory bail by the order dated 01.08.2018 passed by this Court in Cr. Misc. 43635 of 2018.

It has been submitted that due to inadvertence in the prayer portion of original bail petition, "Chief Judicial Magistrate, Gogari" has wrongly been mentioned whereas it should have been "Additional Chief Judicial Magistrate, Khagaria" as a consequence thereof, the same mistake has occurred in the order dated 01.08.2018 passed in Cr. Misc. 43635 of 2018.

Patna High Court Cr.Misc. No.51344 of 2018 (2) dt.29-08-2018 2/2 Counsel for the petitioner is directed to make necessary correction in prayer portion of the original bail petition during course of the day.

In such circumstances, let 8th line of last paragraph of the order dated 01.08.2018 passed in Cr. Misc. No. 43635 of 2018 in place of "Chief Judicial Magistrate, Gogari" be read as "Additional Chief Judicial Magistrate, Khagaria". The order dated 01.08.2018 passed in Cr. Misc. No. 43635 of 2018 is modified to the extent indicated above. In such circumstances, further four weeks' time is granted to the Petitioners from the date of receipt/production of copy of this order to surrender before learned Additional Chief Judicial Magistrate, Khagaria, in connection with Parbatta (Bharat Khand) P.S. Case No. 415 of 2017 in terms of the order dated 01.08.2018 passed by this Court in Cr. Misc.43635 of 2018. This modification application stands allowed. (Sanjay Priya, J) S.Ali/- U T
