2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 21(b), 22(b) and 25 of the Narcotic Drugs and Psychotropic Substance Act.

3. The case of the prosecution is that 90 grams of 'brown sugar' was recovered from the conscious possession of the petitioner.

4. Learned counsel for the petitioner submits that the quantity of 'brown sugar' which was recovered from the possession of the petitioner is much less then commercial quantity of 250 grams. Further submission is that charge sheet has already been filed. Moreover, the petitioner is languishing in

Patna High Court CR. MISC. No.86504 of 2024(3) dt.10-02-2025 2/2 judicial custody since 10.09.2024.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mojahidpur P.S. Case No. 208 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur/concerned court.
