JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner, counsel for the complainant and the counsel appearing for the State. The petitioner is apprehending arrest in connection with Complaint Case No. 2271 of 2018 for the offence under Section 498A of the Indian Penal Code.

Allegation against this petitioner is that he has tortured his wife for non-fulfillment of dowry demand. Learned counsel for the petitioner submits that petitioner and his family never demanded any dowry. Therefore, question of torture for non-fulfillment of dowry demand is unsustainable. He further submits that the petitioner is ready to keep his wife with full care, honour and dignity.

Patna High Court CR. MISC. No.76155 of 2019(3) dt.16-03-2020 2/2 Learned counsel appearing on behalf of the complainant submits that the wife is also ready to live with the husband.

Considering the fact that the petitioner is ready to keep his wife with full care, honour and dignity, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within one month from today, on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Complaint Case No. 2271 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In the event petitioner neglects, misbehaves or tortures the informant of this case, the Court below shall be at liberty to cancel the bail bond of the petitioner. (Anil Kumar Upadhyay, J) Rishi Kumar/- U T
