Petitioner apprehends arrest in connection with Lauriya P.S. Case No.265 of 2017 registered for the offences under Sections 406, 409, 420, 467, 468 and 471/34 of IPC. Allegation against the petitioner is of misappropriation of government money and financial irregularity with respect to distribution of cycle among the students.
It has been submitted that the allegation against this petitioner is not specific. The withdrawal of amount was made under joint signature of In-charge Headmistress Pushpa Clement and Clerk Sri Braj Bhushan Tiwary of concerned school. This petitioner is a peon and he was authorized to collect money
Patna High Court Cr.Misc. No.52702 of 2018(3) dt.17-12-2018 2/2 under different cheques. The said Pushpa Clement being Incharge of concerned school has been allowed anticipatory bail by one of the coordinate bench of this Court in Cr.Misc.No.13895 of 2018 on 19.06.2018. The case of this petitioner stands on similar footing.
The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioner, in the event of arrest or surrender before the learned court below within six weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bettiah, West Champaran in connection with Lauriya P.S. Case No.265 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
