2. Heard learned counsel for the appellant and the State.
3. This appeal has been filed against the order dated 04.10.2023 passed by learned Exclusive Special Judge, SC/ST Act, Patna in ABP No. 5514 of 2023 arising out of Rajiv Nagar P.S. Case No. 448 of 2019, Special Case No. 429 of 2019, registered under Sections 147, 148, 149, 447, 341, 342, 323, 325, 354, 379, 504, 506, 509 of the Indian Penal Code and Section 3(1)(R)(S)(W) of Scheduled Castes and Scheduled
Patna High Court CR. APP (SJ) No.5416 of 2023(5) dt.18-11-2025 2/3 Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
4. As per prosecution case, on the order of this appellant, other co-accused persons abused informant by caste name and assaulted him with butt of rifle.
5. Learned counsel for the appellant submits that appellant is only alleged to be the order giver and there is no specific allegation of any overt act against him. Appellant is not alleged to have abused informant by caste name as such, no case under SC/ST Act is made out against him.
6. Learned Spl. Public Prosecutor for the State vehemently opposed the bail application.
7. Considering the aforesaid facts, let the appellant, as named above, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, SC/ST Act, Patna in connection with Rajiv Nagar P.S. Case No. 448 of 2019, Special Case No. 429 of 2019.
8. Accordingly, this criminal appeal is allowed and impugned order dated 04.10.2023 is set aside with respect to
Patna High Court CR. APP (SJ) No.5416 of 2023(5) dt.18-11-2025 3/3 this appellant only.
