Petitioner, who is in custody, seeks bail in connection with Special Case No. 349 of 2017 arising out of Gandhi Maidan P.S. Case No. 515 of 2017 registered for the offences punishable under Sections 367, 468, 471, 409, 420, 120(B) and 34 of the Indian Penal Code and under Section 13(i) (c) (d) read with 13(ii) of P.C. Act.

Allegation against petitioner is of embezzlement and misappropriation of government money.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is a Block Co-

Patna High Court Cr.Misc. No.62837 of 2018(3) dt.26-10-2018 2/2 Ordinator in Maner Block of Patna District. The money was allotted to him which has been properly utilized in construction work and placed all the required documents. Regarding expenditure made Rs. 4,20,000/- was transferred in his account as he had constructed soak-pits by the order of Department. He has no criminal antecedent. He is in custody since 22.11.2017. Petitioner had earlier moved for grant of regular bail which was rejected by the order as contained in Annexure-1. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Vigilance 1st, Patna in connection with Special Case No. 349 of 2017 arising out of Gandhi Maidan P.S. Case No. 515 of 2017.
