Mr. Awadhesh Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-11-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. Petitioners seek regular bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.
3. As per the F.I.R., all the accused persons, including these petitioners, assaulted the informant and his family members, due to which the informant's son sustained injuries and subsequently died during the course of treatment.
4. Learned counsel for the petitioners submits that specific accusation of assault is against co-accused Munappra Kumar who is alleged to have given iron rod blow on the head
Patna High Court CR. MISC. No.81088 of 2025(2) dt.27-11-2025 2/2 of the deceased. Allegation of assault against these petitioners is general and omnibus and petitioners are in custody since 28.06.2025. It is further submitted that similarly situated coaccused person has already been granted regular bail by coordinate Bench of this Hon'ble Court vide order dated 14.05.2025 passed in Cr. Misc. No. 14744 of 2025. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna City, Patna in connection with Didarganj P. S. Case No. 21 of 2024.
