Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 353, 333 and 427 of the Indian Penal Code. Petitioner is in custody since 29.07.2019. Police had arrested the petitioner and to procure forceful release of the petitioner, the other named accused allegedly attacked on police party and obstructed in the discharge of their official duty. Submission is that there is no overt-act as alleged against the petitioner.

Considering the aforesaid submission, let the above named petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.75869 of 2019(2) dt.28-11-2019 2/2 Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge Excise Act, Buxar in connection with Brahmpur (Chakki) P.S.Case No.330 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial/investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
