The petitioner seeks bail in Chand P.S. Case No. 05/2018, instituted for the offences under Sections 302 and 120(B) and 34 of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that as usual father of informant had gone to attend call of nature with this petitioner. It is further alleged that dead body of father of informant was found after half an hour near chamber of this petitioner. Informant raised suspicion against this petitioner.

Learned counsel for the petitioner has submitted that informant has filed another application before the police on the next date, i.e. 10.01.2018 stating that he has come to know the

Patna High Court Cr.Misc. No.56430 of 2018 (3) dt.01-11-2018 2/2 name of two other persons, namely, Ram Ashish Yadav and Murari Srivastava, who were involved in the aforesaid occurrence. In this manner, besides suspicion there is no other material against this petitioner. He is in custody since 22.06.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IVth, Kaimur at Bhabhua in connection with Chand P.S. Case No. 05/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
