Mr.Bharat Bhushan(APP 156) ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-12-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kurtha (Manikpur O.P.) P.S. Case No. 229 of 2018 for the offence registered under Sections 364(A) and 34 of the Indian Penal Code. Later on Section 302 of the I.P.C. was also added. The allegation is regarding the petitioner and the coaccused person, namely, Anil Kumar having gone with the deceased victim boy to watch a cricket match and thereafter the said deceased boy did not return and it was found that he has been murdered.

The learned counsel for the petitioner has submitted that there is no material whatsoever so as to connect the petitioner with the alleged crime. It is further submitted that the petitioner is having a clean antecedent, he is a student and

Charge sheet has also been submitted in the present case and there is no requirement of the petitioner for custodial interrogation. Lastly, it is submitted that the petitioner is ready to abide by whatever conditions as may deem fit and proper to be imposed by this Court.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Jehanabad in connection with Kurtha (Manikpur O.P.) P.S. Case No. 229 of 2018.

It is needless to state that the petitioner would mark his presence before the Officer In-Charge of the concerned Police Station at 10:00 A.M. on each and every Monday of the month and in the event of his failure to do so on two consecutive occasion, the present privilege of bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.
